Course Syllabus

Abstract

Academic course «Экономический анализ права» (Law & economics / Economic analysis of law) is devoted to the study of the main theoretical concepts and institutions of economic analysis of law, which emerged in the 1960s-1970s as a branch of scientific thought that uses economic tools to analyze existing law and investigates the impact of legal norms on the economic behavior of individuals. The aim of this course is to teach students the basics of economic analysis of law to the extent necessary to solve individual problems of legislation and law enforcement. As a result of the course, the student will learn to analyze the costs and benefits of legal regulation and to use economic tools to assess the effectiveness of individual institutions of law. In addition, the student can use the learnt economic and legal tools to solve complex practical issues arising at the intersection of the two sciences or to conduct interdisciplinary research. The discipline provides compulsory preparation for each seminar class (written and oral homework), group project, final written exam. There are no blocking elements of control. To successfully master the discipline, students must possess the following knowledge and competences: know the basics of economic theory; basic theoretical concepts, legislation and judicial and arbitration practice on key issues of law; have the abilities to work with scientific literature, analytical and statistical materials.

  • to know the main directions of economic analysis of law, the difference between positive and normative economic analysis of law; the difference between the categories of «economic grounds» and «non-economic grounds» of legal regulation; the essence of the concepts of «market failures», «externalities», «fairness», «paternalism»
  • to know the categories of «behavioral economics», «cognitive distortion», «nudge theory», «default rules»; the main strategies of optimal distribution of risks and obligations in a contract
  • to be able to analyze the costs and benefits of legal regulation; evaluate proposed legal regulation from the point of view of economic efficiency; distinguish between the means of protection of civil rights under the property rule and the means of protection of rights under the liability rule; analyze corporate relations from the point of view of agency and behavioral theory; apply game theory in the analysis of torts; conduct economic analysis of the main provisions of a contract
  • to have skills of applying the methods of analysis of legal norms from the position of behavioral economics and determination of options for their optimization; methods of application in practice of the main means of increasing the efficiency of corporate activity; methods of economic analysis of mergers and acquisitions; tools of assessment and compensation of damages in tort relations; main tools of effective contract termination
