About the School

HSE University’s School of Legal Regulation of Business was established in 2020. It provides instruction in academic areas covered by the Faculty of Law: private international law, corporate and business law. Currently, the school employs more than 50 highly qualified specialists in various fields of law, including private international law, Russian and international corporate law, and Russian business law.

We are focused on teaching legal disciplines at the University at the same level as the world's top universities, taking into account the specifics of students’ curriculum at various degree programmes. The school is actively engaged in the provision of several undergraduate and graduate programmes at the University.

Abstract

Курс сочетает в себе элементы теории права, сравнительного правоведения и актуальную правоприменительную практику. В рамках курса рассматриваются основные институты права интеллектуальной собственности: авторское право и смежные права, патентное право, права на средства индивидуализации. В курс также включены разделы по международно-правовой охране авторского права, патентного права, права товарных знаков и знаков обслуживания. A unique course will help students to get a comprehensive legal education in the field of intellectual property in a fairly short time. The objective of the course is to be as practice-oriented as possible. The course examines the main institutions of intellectual property law: copyright and related rights, patent law, trademark law, legal regulation of domains. The course also includes sections of intellectual property in Software, Artificial Intelligence, Internet of Things and Big Data. The course combines elements of legal theory, comparative jurisprudence and current law enforcement practice with an emphasis on the latest technology

Learning Objectives

The aim of the course is to provide students with a theoretical and practical understanding of the international regulatory framework of the global intellectual property protection system, covering copyright, related rights, patents, trademarks, confidential information (know-how), enforcement of IP rights and international commercial transactions with IP in digital age. A special emphasis is put on the World Intellectual Property Organization, World Trade Organization standards, and recent developments in EU and EEU law.

Expected Learning Outcomes

Students must gain knowledge on: - subject and sources of Intellectual Property (IP) Law in Digital Age (national and international level); - main principles of national law applicable to national and cross-border commercial transactions with intellectual property rights; - national and international market practice for structuring and documenting national and cross-border commercial transactions with intellectual property rights;
Students must gain knowledge on: - main provisions, scope of application and content of the market standard legal documentation applicable to commercial transactions with intellectual property rights and the relevant legal concepts and vocabulary; - jurisdiction of national courts to resolve disputes arising out of commercial transactions with intellectual property rights.
Skills and abilities: ─ ability to use specific terms customary in the context of national and international Intellectual Property (IP) Law in Digital Age; ─ understanding main legal concepts and areas of law applicable to commercial transactions with intellectual property rights; ─ understanding the structure of commercial transactions with intellectual property rights and the main legal documentation (contracts) documenting such transactions;
Skills and abilities: ─ practical abilities to undertake a research and analysis of judgments, decisions and academic writings; ─ skills to analyze and solve cases, putting together a legal position and compose transactional documents documenting commercial transactions with intellectual property rights.
Students should gain the following competences: ─ ability to work with information (search, evaluate, use information, necessary for fulfilment of academic and professional tasks, from various sources, including application of the systematic approach); ─ ability to carry out professional activities in the international market environment;
Students should gain the following competences: ─ ability to search, analyze and work with legally relevant information by using of juridical, comparative and other specific methods; ─ ability to describe legal problems and situations in the area of cross-border commercial transactions with intellectual property rights.
