Семинар на тему: 'Mistake of Fact in International Law – Unexplored Terrain'

The notion of mistake of fact has hardly ever been addressed and discussed in systemic fashion in international legal scholarship. However, the recent example of an alleged human error in the case of the Ukrainian Boeing 737 shooting down an Iranian missile near Tehran on January 8, 2020, has broken to elucidate the inconsistency in how international law deals with the cases involving a mistake of fact.

There are two major approaches in International Law on how to address the cases with the mistake of fact: by individual criminal responsibility, which is laid down in international criminal law (ICL) and in international humanitarian law (IHL), and, by state responsibility. Neither is able to respond adequately to situations generated by the aforementioned ‘mistakes’.

The presentation will be dedicated to the issue of mistake of fact in International Law today with the special focus on cases involving the use of cyber technologies and artificial intelligence.
