Synopsis: Competition law is designed to maintain and promote fair and healthy competition in the market. Given the relatively nascent jurisprudence in this field, India draws much of its framework from other regimes such as the EU, the U.K., and the U.S.A. Against this backdrop, the lecture will discuss India’s competition law framework with a focus on contemporary issues, particularly the challenges posed by digitalization. Regulating digital markets raises unique difficulties due to network effects, multi-sided platforms, and the rapid pace of technological change. Balancing innovation, consumer welfare, and fair competition, while coordinating with global enforcement trends, will be crucial as India develops its regulatory approach in the Big Tech era.
