The article is devoted to the problem of the possibility of international human rights protection through the imposition of sanctions on the example of the US Global Magnitsky Human Rights Accountability Act. The authors conclude that, despite the declared values, the effect of such acts on the states’ cooperation in the area of human rights protection and on international law in general can be more negative than positive. The spread of this legal transplant often contributes to the politization and transformation of human rights from a sphere of cooperation into a sphere of rivalry between states, which in the end can seriously harm the existing system of international human rights protection. In preparing the article, the authors used comments and questions received from UN Special Rapporteur on the negative impact of unilateral coercive measures on the enjoyment of human rights, Doctor of legal sciences, Professor of the BSU University Alena Douhan, RIAC Director General, Associate Professor at MGIMO University Ivan Timofeev and other participants of the event to discuss the draft article held by the International Justice Laboratory in September this year.
