Course Syllabus

Abstract

This course, taught in English, is designed to familiarize students with the new conditions in which human rights are realized in the development of the information society and its main phenomenon - the Internet. When deciding on the implementation of rights and freedoms on the Internet, the level of development of the information society should be taken into account. Its development affects both the cultural aspects of human rights (varying depending on the national segment of the Internet) and the enforcement practice of their implementation. Today, the right to access information comes to the fore, being the fundamental human right in the information society. We are faced with fundamentally new phenomena when the line between the producer and the consumer of information is erased. Any user can theoretically become a producer of mass media by keeping personal diaries (blogs), posting information on social networks, communicating via e-mail, electronic conferences (chats) and using other opportunities provided by the modern level of development of network technologies. Three levels of Internet governance can be distinguished: international, national (state) and the level of self-regulation. Due to the specifics of the Internet, none of these levels can be self-sufficient or the only possible one. It is necessary to show the relationship between each of the levels and determine the role of each of them in the implementation of constitutional rights and freedoms on the Internet. These issues will be the subject of this course. The course includes the viewing and analysis of videos of leading international experts on Internet governance and their discussion in seminars.
Learning Objectives

Learning Objectives

  • The first goal is to study and study the construction and functioning of institutions for the protection of constitutional human rights and freedoms on the Internet, which, due to their limited time resources, are not considered or touched upon very superficially when studying the general courses of constitutional law of Russia.
  • The second goal is a deeper study of problems in comparison with general courses caused by both the legal regulation of public relations arising from the regulation and protection of constitutional rights and freedoms on the Internet, and law enforcement practice in the relevant field.
  • The third goal is to teach future masters of law the basics of Cont-identification of relevant scientific and practical problems arising in the field of the implementation of constitutional rights and freedoms on the Internet, their “diagnosis”, as well as descriptions and methods of proposals for their solution; orientation among an extensive regulatory array and scientific literature. As part of this goal, it is supposed to hear reports on the stages of preparation of the master's thesis.

  • have the skills to compile complaints and applications to domestic and international bodies for the protection of constitutional rights and freedoms of people on the Internet.

  • Foreign experience of using the Internet in the implementation of constitutional rights and freedoms of citizens.
    The Internet and the issue of universalization of human rights. The relationship of legal and information culture in the implementation of constitutional rights and freedoms on the Internet. The problem of jurisdiction on the Internet. Different approaches to using the Internet in the implementation and protection of human rights and freedoms. The role of information ethics in the implementation of rights and freedoms on the Internet.
  • Evolution of the legislation of the Russian Federation in the field of human rights in the context of the development of the information society.
    Legal consolidation of the formation of the information society in Russia. The legislation of the Russian Federation on information and its impact on the implementation of constitutional rights and freedoms of citizens. Legislative initiatives to streamline online relationships. The rights and freedoms of man and citizen on the Internet: reflected in judicial practice. The information culture of Internet users and its reflection in law enforcement practice.
  • The right to access information on the Internet: a positive approach .
    The experience of formation and practical experience in implementing electronic government in foreign countries. The concept of the formation of electronic government in the Russian Federation. The provision of public services on the Internet. The evolution of the concept of electronic government. Directions for the development of electronic government in the Russian Federation.
  • The right to access information on the Internet: a negative approach.
    The fundamental importance of the principle of accessibility of information for the realization of the rights and freedoms of citizens in the information society. The right of access to information on the Internet: a technical and ideological role. Access to information on the activities of state authorities and local Self-government in the Russian Federation on the Internet Access to information on the activities of the courts of the Russian Federation on the Internet The relationship of access rights to information on the Internet and other constitutional rights.
  • The Internet and the implementation of personal rights and freedoms of citizens.
    Realization of the rights to life and health. Realization of the right to privacy. Realization of the right to protect one’s honor and dignity, to secrecy of correspondence, telephone conversations, mail and other messages. Realization of freedom of thought and speech, the right to search, collect, store and disseminate information by any legal means. Realization of freedom of conscience and religion
  • The Internet and the implementation of political rights and freedoms of citizens
