MANDATORY CORPORATE HUMAN RIGHTS DUE DILIGENCE MODELS: SHOOTING BLANKS?

Rusinova V., Sergei K.

Law. LAW. Высшая школа экономики, 2021

We would like to announce the selection of students that wish to participate in the international BRICS Lex Model

This competition is dedicated to issues of international investment law and investment disputes and will take place in English.

However, unlike traditional moot courts, this competition (BRICS Lex Model) will take the form of a diplomatic conference during which students will represent BRICS+ states in seeking to draft and agree on a multilateral investment treaty on the encouragement and protection of investment, which will (1) cover the key aspects of an investment protection regime (such as substantive standards of protection, exceptions, dispute settlement, etc.) and (2) be based on the latest trends in this area and consider existing arbitral awards rendered in the context of bilateral and multilateral investment treaties.

This competition is organized by the HSE University's Faculty of Law and is open to all BRICS+ universities. The competition includes a written phase (legal memorandum with proposals on the potential BRICS+ investment treaty, which is due by 5 September 2025) and an oral phase (diplomatic negotiations on the BRICS+ international investment treaty in Moscow in the course of 1 December 2025 through 5 December 2025).

Students of the HSE University's Moscow campus that are enrolled in the Faculty of Law's Bachelor or Master programs (regardless of specialization or track) that are interested in taking part in this competition are invited to submit their applications via email to vkoscov@hse.ru by 15 May 2025.

Applications should include the following:

  1.  your CV;
  2. a motivation letter in English; and
  3. a brief legal essay in English explaining which topic of interest to be included into the ultimate investment treaty (as listed in the competition problem) you would most like to work on and which preliminary proposals on this topic of interest you may wish to put forward for the team's benefit (compared to the provisions of already existing investment treaties and considering legal literature and case law -- please provide references where relevant).

There are no formal requirements to the length or content of these documents. After the initial stage of the selection process, an interview may be scheduled with certain students to finalize the team composition and complete the selection. Should you have any questions, please reach out by email at: vkoscov@hse.ru

Successful students that become part of the team will be enrolled in the HSE University's for-credit project and will accordingly receive project credits per HSE University's rules.
