Course Syllabus

Abstract

The discipline «International labour standards» is drafted for Master’s Programme "Legal Support for Corporate and Human Resource Management“. This short course allows students to grasp reflection of the ideas of nature of international labour standards, its sources, principles and some institutions including social dialogue in the sphere of labour and international legal regulation of labour dispute prevention and resolution. All lectures are listen in format of online-course. Seminars are held in auditoriums. In accordance with part 4 of the article 15 of the Constitution of the Russian Federation the universally-recognized norms of international law and international treaties and agreements of the Russian Federation shall be a component part of its legal system. If an international treaty or agreement of the Russian Federation fixes other rules than those envisaged by law, the rules of the international agreement shall be applied. Also The Russian Federation is important member of the International Labour Organization and several regional organizations (such as the Council of Europe) which constitute international labour standards. But in some aspects there are appeared collisions between Russian legislation and international labour standards. How we can implement and international labour standards and resolve these collisions? During this course students try to find answer on this question and some other issues.

Learning Objectives

• The course aimed at forming competences necessary for using knowledge about international labour standards in the practice sphere and representation of employee, employer or state at all levels from local to international. Students will learn how to determine: - legal nature of the international labour standards; - how to resolve individual and collective labour disputes; - how to protect rights and legal interests of employees using knowledge about international labour standards; - how to participate in co-determination, collective bargaining and consultations; - how to participate in activity of the International Labour Organization, federations of trade unions and federations of employers.

Expected Learning Outcomes

• After successful completion of this course, students will be able to: - know all aspects of international labour standards; - analyze compliance of the Russian labour law with international labor law; - consult clients and provide legal support for employers, employees and stakeholders seeking to protect their rights in regard to employment relations matters;
• After successful completion of this course, students will be able to: - understand an international dimension of employment and labor law and know it application in industrial relations in Russia; - acquire skills of participation in social dialogue as representative of employee or employer; - acquire skills to make a complaint in International Labour Organization;

  Экзамен проводится в устной форме на английском языке. Экзамен проводится на платформе Zoom (https://zoom.us/). К экзамену необходимо подключиться согласно расписанию ответов, высланному преподавателем на корпоративные почты студентов накануне экзамена. Перед началом экзамена проверяется работа платформы у всех студентов. Компьютер студента должен удовлетворять требованиям: наличие рабочей камеры и микрофона, поддержка Zoom. Для участия в экзамене студент обязан: поставить на аватар фотографию, включить камеру и микрофон. Во время экзамена студентам запрещено: читать с экрана, отходить от монитора, отключать Интернет, общаться (в социальных сетях, с людьми в комнате), списывать. Во время экзамена студентам разрешено: иметь на столе только воду, очки и англо-русский словарь в печатной версии. Кратковременным нарушением связи во время экзамена считается нарушение связи менее минуты. Долговременным нарушением связи во время экзамена считается нарушение минута и более, чтение с экрана, выход из зоны видимости преподавателя. При долговременном нарушении связи студент не может продолжить участие в экзамене. Процедура пересдачи аналогична процедуре сдачи и проводится в устной форме на английском языке.
