Course Syllabus

Abstract

Intellectual property plays a significant role in the modern economy, in particular in the digital field. Each country has its own system of intellectual property protection, which includes such basic types of intellectual property rights as utility models and patents (for inventions), trademarks, industrial designs, trade secrets, copyright and related or related rights. However, a feature of intangible assets is the ease of their distribution, including at the same time, at the international and regional levels, there are and are actively developing tools for harmonizing legislation. This process began in the 19th century with the adoption of the first international conventions in this area, continued with the creation of the World Intellectual Property Organization (WIPO).

Learning Objectives

• The main goal of studying this course by students should be the formation of basic concepts of intellectual property as it is perceived in foreign legislation, as well as an understanding of the main mechanisms of international regulation and knowledge of key aspects.

Expected Learning Outcomes

• Skills and abilities : to use specific terms and sources of the global IP Law and Regulation; practical abilities of research, analysis of WIPO, WTO, EU and EEU legal documentation and scientific works; skills to analyze and solve cases, building up of the legal position and composition of procedural documents on cases in the sphere of International IP Law and Regulation.
• Students must gain knowledge on general standards of IP protection under WIPO, WTO, EU and EEU Law; enforcement of IP rights in the global prospective; drafting international commercial transactions with IP component.
• Students should gain the following competencies: ability to work with information (search, evaluate, use information, necessary for fulfillment of academic and professional tasks, from various sources, including application of the systematic approach); ability to carry out professional activities in the international environment.
• To know the main institutions of intellectual property law; features of subjects and objects of law; be able to determine the distinctive features of subjects, various categories of objects; apply the rules governing these relations.
• To know the origins of the development of intellectual property rights; the concept of IP; features of the use of IP; the significance of the results of intellectual activity and means of individualization in modern society; be able to operate with terminology in the field of regulation of the results of intellectual activity and means of individualization; own concepts and categories used in intellectual property law.
• To know the criteria for determining an object as a IP; the concept of ‘intellectual rights’; be able to identify the features as objects of intellectual property; have the skills to determine the criteria for objects of intellectual property.

• International regulation of industrial property
• Regulation of intellectual property protection in Internet
• International commercial transactions with intellectual property rights
• Enforcement of Intellectual Property in global perspective

Assessment Elements

• presentations at the seminar devoted to discussion of case studies
  (group up to 3 people or individual)
• Test (online)
  at LMS platform (up to 10 multiple choice questions and 3 questions that require detailed answer), duration — 2 hours, stable Internet connection required. No video or audio requirements.
• Attendance, active participation and in-class discussion
